Non-Compete Clause

Non-Compete Clause

A contractual provision restricting an employee from working for a competitor after leaving their employer in Saudi Arabia.

A non-compete clause in a Saudi employment contract restricts an employee from working for a competitor or establishing a competing business after their employment ends. Under Saudi Law, non-compete clauses must be reasonable in scope — covering a specific time period, geographic area and industry category. Overly broad provisions may be challenged as unenforceable. Non-compete clauses are particularly common for senior executive roles, sales positions and roles involving access to trade secrets or proprietary client relationships. Inclusive Solutions advises on drafting enforceable non-compete clauses that align with Saudi Labor Law requirements.
